Agreement to Terms

By accessing or using the services provided by forest-quartz, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you should not use our services.

Service Description

forest-quartz provides professional digitisation services for photographs, film negatives, slides, and related photographic materials. We offer scanning, restoration, and archival services to preserve and convert physical photographic materials into digital formats.

Client Responsibilities

When using our services, you agree to:

  • Provide accurate contact and project information
  • Ensure you have legal rights to the materials submitted for digitisation
  • Package materials securely for transit
  • Comply with payment terms as specified
  • Collect or arrange return of materials within the specified timeframe

Intellectual Property Rights

You retain all intellectual property rights in the original materials and the resulting digital files. By submitting materials to us, you grant us permission to handle, scan, and process these materials solely for the purpose of providing our services. We do not claim ownership of your materials or the resulting digital files.

You warrant that you have the necessary rights to submit materials for digitisation and that doing so does not infringe upon the rights of any third party.

Pricing and Payment

Prices are quoted in British Pounds and are subject to change without notice. Final pricing will be confirmed before work commences. Payment is required upon completion of services unless alternative arrangements have been made in advance. We accept payment by bank transfer and major credit cards.

If materials require significantly more work than initially estimated, we will contact you with a revised quotation before proceeding.

Material Handling and Insurance

We take great care in handling all materials entrusted to us. Your materials are insured against loss or damage whilst in our possession up to a value of £500 per project unless higher coverage is arranged in advance.

We recommend that clients use tracked and insured postal services when sending materials. We cannot be held responsible for materials lost or damaged in transit to our facility.

Limitation of Liability

Whilst we exercise reasonable care in handling materials, some photographic materials are inherently fragile and may be damaged during processing despite our best efforts. We cannot guarantee that fragile, deteriorated, or damaged materials will survive the scanning process without further deterioration.

Our liability for any loss or damage is limited to the declared value of the materials or £500, whichever is lower, unless higher coverage has been specifically arranged and paid for.

We are not liable for any indirect, consequential, or sentimental losses.

Quality Standards

We endeavour to produce high-quality digital files that accurately represent the original materials. However, the quality of output is dependent on the condition of the source materials. Faded, damaged, or low-quality originals will produce correspondingly limited digital files.

If you are not satisfied with the quality of the work, please contact us within seven days of receiving your files so we can address any concerns.

Turnaround Times

Estimated turnaround times are provided in good faith but are not guaranteed. Actual completion times may vary depending on project complexity and current workload. We will inform you if significant delays are anticipated.

Cancellation and Refunds

You may cancel your order before work commences for a full refund. Once scanning or restoration work has begun, cancellation will result in charges for work completed to that point. Completed work is non-refundable except in cases where the work fails to meet the agreed specifications.

Storage and Collection

Original materials will be held for collection or return for 30 days following project completion. After this period, storage fees may apply. Materials not collected within 90 days may be disposed of at our discretion following reasonable attempts to contact you.

Digital files are available for download for 90 days following completion. After this period, we cannot guarantee availability of files.

Prohibited Materials

We reserve the right to refuse service for materials that:

  • Contain illegal content
  • Infringe upon copyright or other intellectual property rights
  • Are contaminated or present health and safety risks
  • We believe you do not have the right to possess or reproduce

Privacy and Confidentiality

We treat all client materials with strict confidentiality. Staff members handling your materials are bound by confidentiality agreements. We do not disclose the content of materials to third parties except as required by law.

Changes to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the modified terms.

Governing Law

These Terms of Use are governed by the laws of England and Wales. Any disputes arising from these terms or our services will be subject to the exclusive jurisdiction of the courts of England and Wales.
